Sunni Books Permitting Nikkah Al Mut'ah

The bakris are always quick to assert that Shias engage in Mut'ah marriage that they consider as haram, and a marriage that is borderline prostitution let alone a Sunnah. Nothing could be further from the truth as it is apparent that many amongst the Sunni school consider Mut'ah marriage to be a valid practice.


For Example take Imam Malik who allowed Mut'ah Marriage.

Imam Al-Sarakhsi says:

And the meaning of Mutah is to say to a woman "I marry you for this duration and this much dowry" And this is a not permissible in our opinion (Hanifis), but allowed by Malik Ibn Anas' (Malikis) opinion and this is obviously the opinion of Ibn Abbas (Sahahbah) as well, may Allah be pleased with him, and he argued for it with the statement of Allah Almighty: "And those of whom ye seek content (Istimta), give unto them their portions as a duty." [4:24]

Abdulrazaq – Ibn Juraij – Abdullah bin Uthman bin Khathim said: 

‘In Mecca there was a pretty Iraqi woman who was performing pilgrimage and she had a son named Abu Umaya. Saeed bin Jubair used to visit her frequently, thus I said: ‘O Aba Abdullah, why do you visit this woman so frequently?’ He replied: ‘I have got married to her via that marriage – Mut’ah -. Saeed further added: It is –Mut’ah – as lawful as drinking water’’.

عَنِ ابْنِ جُرَیْجٍ قَالَ: أَخْبَرَنِی عَبْدُ اللَّهِ بْنُ عُثْمَانَ بْنِ خُثَیْمٍ قَالَ: کَانَتْ بِمَکَّةَ امْرَأَةٌ عِرَاقِیَّةٌ تَنَسَّکُ جَمِیلَةٌ لَهَا ابْنٌ یُقَالُ لَهُ: أَبُو أُمَیَّةَ، وَکَانَ سَعِیدُ بْنُ جُبِیرٍ یُکْثِرُ الدُّخُولَ عَلَیْهَا، قُلْتُ: یَا أَبَا عَبْدِ اللَّهِ مَا أَکْثَرَ مَا تَدْخُلُ عَلَى هَذِهِ الْمَرْأَةِ قَالَ: إِنَّا قَدْ نَکَحْنَاهَا ذَلِکَ النِّکَاحَ لِلْمُتْعَةِ قَالَ: وَأَخْبَرَنِی أَنَّ سَعِیدًا، قَالَ لَهُ : هِیَ أَحَلُّ مِنْ شُرْبِ الْمَاءِ لِلْمُتْعَةِ

Imam Dhahabi:

سمعت الشافعي يقول استمتع ابن جريج بتسعين امرأة حتى إنه كان يحتقن في الليل بأوقية شيرج طلبا للجماع

“al-Shafiyee said that Ibn Juraij (Taba Al Tabiee) did Mut’ah with 90 women, he used every night one ounce of sesame oil in order to have sexual intercourse”.

Further, Imam Ibn Hazm provides a list of several of the Sahaba who permitted Nikkah Al Mut'ah. He states: 

It is firmly established that after the death of the Messenger of Allah, a huge number of the Salaf consider Mut'ah to be halal, and among them were Sahabah. Among those Sahabah are:

1. Asma daughter of Abu bakr 
2. Jabir ibn Abdullah
3. Ibn Mas'ud
4. Ibn Abbas
5. Mu'awiyah ibn Abu Sufyan
6. Amr ibn Harith
7. Abu Sa'eed al-Khudri
8. Salamat
9. Ma'bad Abna' Ummayah bin Khalaf

Not only was it that Mut'ah was permitted in the time of the Prophet for the men of the Ummah but it was also permitted for the women. Indeed, Asmah bint Abu Bakr (The elder sister of Aisha) engaged in this temporary marriage with Zubair, and conceived Abdullah bin Zubair through it!

Imam al-Raghib al-Isfahani stated:

"Ibn Zubair denounced Ibn Abbas for his opinion on Mut'ah. Thus Ibn Abbas told him: "Go and ask your mother what she did with your father." When Ibn Zubair asked her, she said: "By God, I did not conceive you except through Mut'ah".

This is further supported by a Hadith that is Sahih Al Sanad whereby Asma is asked about the Mut'ah of women and she admits that they used to perform such a marriage in the time of the prophet (s).

We went to ask Asma' bint Abu Bakr about Mut'ah of women so she said: We did it during Rasulallah's (SAW) time.

So next time someone calls you a son of Mut'ah, make sure to ask them "You mean like Ibn Zubair (RA)?" 😂

Some other Sunni Scholars who allowed Mut'ah marriage:

In the book titled Mutah in the Fiqh of Ahlul Sunnah by Hafiz bin Faaruq (Page 74 onwards) the author lists the fatwas of several Sunni scholars who deemed temporary marriage as Halal including:
  • Imran Bin Husein (who's opinion on the permissibility of Mut'ah after the prophets death is well-known).
  • Abul A'la Maududi (Former head of Jamaat e Islami movement)
  • Muhammad Al Tahir Ibn Ashrub (Highest Maliki Scholar of his era mentions it in Tafsīr al-taḥrir wa-al-tanwir)
  • Imam Fakhruddin Ar-Razi
  • Imam Ahmad Bin Hanbal
The author on page 104 also quotes Ibn Hazm's book (the same one as above, Al Muhalla) with an even larger list of Sahaba who were proponents of Mut'ah.

Imam Ali, Abu Dhar, Jabir Ibn Abdillah, Abdullah Ibn Abbas, Abdullah Ibn Masud, Zubair Ibn al-Awwam, Imran Ibn Husain, Abdullah Ibn Umar, Ubay Ibn Ka'ab, Abu Sa'id al-Khudri, Salamah Ibn Umayyah, Awka' Ibn Abdillah, Salamah Ibn al-Awka', Khalid Ibn Muhajir, 'Amr Ibn Huraith, Rabi'a Ibn Umayya, Suhair, Sa'id Ibn Jubair Tawoos, Qotadah, Mujahid, Ataa al-Madani al-Suddy, and Imam al-Hasan.

He also sources a list from Ibn Taymiyyah from Ibn Hazm for those Sahaba who allowed Mut'ah on page 104:

According to Ibn Hazm: 

"Ibn Mas'ud, Mu'awiya, Abu Sa'eed (al-Khudri), Ibn 'Abbas, Salama and Ma'bad, the sons of Umayya bin Khalaf, Jabir (bin 'Abdullah al-'Ansaari), and 'Amr bin Huraith continued, after the death of the Prophet, to consider it (i.e. Mut'ah) lawful. Moreover, Jabir reported, regarding all the Companions, that they continued to uphold its lawfulness during the time of the Prophet and of Abu Bakr and almost till the end of 'Umar's caliphate." then he (i.e. Ibn Hazm) adds, "Among the Successors of the Companions, Tawoos, Sa'eed bin Jubair, 'Ataa', and the rest of the Makkan jurists believed in its permissibility."

Sunni scholars in the above video also give the verdict of permissibility of Mut'ah in the Sunni school.

Now that we have firmly established that Nikkah Al Mut'ah is in fact permitted in Islam, and not an innovation at the hands of the Shias it is time to take a look at false marriages that have been innovated by the Bakris in order to circumvent their own rulings forbidding Mut'ah.
